AN ORDINANCE FOR DOGS AND CATS TO CONSTITUTE A NUISANCE WITHIN THE TOWN LIMITS FOR THE TOWN OF SAREPTA AND TO PROVIDE IN CONNECTION THEREWITH; AND ADOPTING THE PROVISIONS OF THE STATE SANITARY CODE BY REFERENCE
BE IT ORDAINED and enacted by the Mayor and Board of Aldermen of the Town of Sarepta, Louisiana, in regular session convened herein on the 18th day of April, 2019 as follows, to wit:
SECTION 1: DOGS AND CATS CONSTITUTING A NUISANCE
It shall be unlawful for the owner of any dog or cat to permit such dog or cat to become a public nuisance within the town limits of the Town of Sarepta. The molesting of passersby, the chasing of vehicles, the habitual attacking of other domestic animals, the disturbance of garbage placed along the roadside for pick up, the trespassing upon private property in such manner as to damage or soil property by a dog, and excessive or continuous barking or other noises made by dogs shall be deemed a public nuisance. The molesting of passersby, the habitual attacking of songbirds in the vicinity of private bird feeders and the trespassing upon private property in such manner as to damage or soil property by a cat shall also be deemed a public nuisance.
SECTION 2: OWNERSHIP OF DOGS AND CATS
It shall be presumed that persons, property owners, or residents of a dwelling who feed or provide water or nourishment for dogs and cats will be presumed to be the owners thereof and subject to the provisions of the ordinance.
SECTION 3: IMPOUNDING DOGS AND CATS
Any dog or cat acting in such manner as to constitute a public nuisance, as defined in Section 1, within the town limits of the Town of Sarepta, may be impounded in premises provided for such purpose, and such dog or cat may be redeemed or reclaimed by the owner in the manner, and upon payment of the fees and charges, as are hereinafter set out in this ordinance; provided, however, a dog or cat which is alleged to be a public nuisance shall not be picked up and impounded without a prior complaint having been made to the police department of the Town of Sarepta by some responsible person.
SECTION 4: ENFORCEMENT OF THIS ORDINANCE
Any dog or cat picked up for impoundment may be taken to and maintained in the pound facilities of Stewart Animal Hospital or other approved and designated facilities.
SECTION 5: DURATION OF IMPOUNDMENT; REDEEMING IMPOUNDED DOGS; PAYMENT OF FEES
The owner of any dog or cat which has been impounded pursuant to the provisions of this ordinance, except only a dog which is being held for observation because it is suspected of having rabies, may redeem or reclaim such animal at any time within ten (10) days after such impoundment; provided, however, the owner of such animal shall pay the Town of Sarepta, upon obtaining the release of such animal, the cash sum of twenty dollars ($20.00), plus a cash sum equal to ten dollars ($10.00), for each day during which such animal is impounded.
SECTION 6: DESTRUCTION OR DISPOSITION OF UNCLAIMED DOGS AND CATS
Any dog or cat pursuant to the provisions of this ordinance, except only dogs being held for observation on account of being suspected of having rabies, which has not been redeemed or reclaimed by the owner within ten (10) days after being impounded shall be destroyed in a humane manner by the Town of Sarepta, or its designee, or such dog or cat may be given to any person who pays the Town of Sarepta the charges and fees due for such impoundment; provided, however, no such dog shall be redeemed or reclaimed by the owner thereof or be given away unless such dog shall then have a current vaccination tag.
SECTION 7: OTHER ENFORCEMENT OF THIS ORDINANCE
In lieu of the impounding provision set forth in Sections 3, 4, 5, and 6 above, and upon the complaint being made to Town Hall or to the Police Department, the Mayor and Board of Aldermen shall be notified in writing of the complaint and correspondence stating the nature of the complaint may be made, in writing, to the property owner or residents advising the nature of the complaint and requiring the property owner or resident to abate the nuisance by the removal or voluntary confinement of the dogs or cats within 15 days from notification. The removal or voluntary confinement of the dogs or cats, the subject of the complaint made, shall be considered satisfactory compliance and satisfaction of this ordinance, but the failure to respond to the written notice timely shall be deemed to be a violation of this ordinance.
SECTION 8: PENALTY FOR VIOLATION
Any person violating any of the provisions of this ordinance or failing to perform any duty imposed by the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than three hundred and no/100 dollars ($300.00), and/or up to thirty (30) days of community service, at the discretion of the court.
